Even the Notoriously Left-Leaning Ninth Circuit Court Agrees That the Second Amendment Exists
On Friday, a majority of a three-judge panel of the notoriously liberal 9th U.S. Circuit Court of Appeals overturned California’s ban on high-capacity ammunition magazines on Second Amendment grounds.
Writing for the majority, Appellate Judge Kenneth Lee wrote that “[E]ven well-intentioned laws must pass constitutional muster.” Lee also argued that the state’s ban on magazines holding more than ten rounds “strikes at the core of the Second Amendment — the right to armed self-defense.”
Lee further added that even though the state passed this ban “in the wake of heart-wrenching and highly publicized mass shootings,” it is “so sweeping that half of all magazines in America are now unlawful to own in California.”
Even though it should be obvious that California’s ban should’ve always been seen as a violation of the Second Amendment, the 9th Circuit is famous for ruling in opposition to conservatives. It’s refreshing to see that they got this one correct.
