Michael Flynn’s Attorney Asks Appellate Court to Remove Biased Judge From Case
The legal team of former national security advisor Michael Flynn, who was effectively exonerated last month after documents were unearthed showing he was set up for a perjury trap, has now asked an appeals court to step in to force Judge Emmet Sullivan to let the DOJ drop the case.
TheBlaze, citing CBS News, reported that Sidney Powell, Flynn’s main lawyer, “filed a petition for a writ of mandamus with the U.S. Court of Appeals for the District of Columbia Circuit on Tuesday that would force U.S. District Judge Emmet Sullivan to approve the Justice Department’s motion” to drop the case, which was entirely based on fraud.
Powell’s filing reads that the “Petitioner respectfully requests that this Court order the district court immediately to (1) grant the Justice Department’s Motion to Dismiss; (2) vacate its order appointing amicus curiae; and (3) reassign the case to another district judge as to any further proceedings.”
Judge Sullivan, in a blatant abuse of judicial power, has refused to honor the DOJ’s motion to dismiss the case against Flynn, instead accepting amicus briefs and asking a Trump-hating former judge to step in and argue why Flynn’s case shouldn’t be dismissed.
TheBlaze further reports that Powell excoriated Sullivan in the filing to the appeals court, saying that “the district judge in this case has abandoned any pretense of being an objective umpire—going too far as to suggest that a criminal defendant who succumbs to a coerced and unfair plea bargain should be prosecuted for contempt.”
Powell added, “In the midst of a national election season, with unprecedented acrimony on all sides of the civic debate, the district judge has dragged the court into the political hurricane—cementing the notion that judges are politicians in robes who use their authority to thwart what they consider the ‘corruption,’ ‘impropriety,’ and ‘improper political influence’ of another one of the political branches.”
Justice must be done here. Flynn has clearly been exonerated, and anyone should be able to see it. Either this “judge” is kicked off the case and General Flynn is able to move on with his life, or Flynn must receive a full, unequivocal pardon from President Trump. Either conclusion is a great way to right the blatant wrongs here.
