Judge Rules ISIS Fighter and Daughter of U.N. Diplomat Cannot Return to United States

A 25-year-old Alabama woman who left the United States in November 2014 for Syria in order to join ISIS, now wants to return to the states. Shocking. However, a judge ruled Thursday that she cannot return because she is not a U.S. citizen.

The woman, Hoda Muthana, was born in New Jersey in 1994 to foreign diplomats based in the U.S. at the time, when her father represented Yemen in the United Nations. When Muthana left for Syria in 2014, she lived under ISIS controlled territory and even had a child from her second marriage to a Tunisian ISIS fighter.

In 2015 the news outlet Buzzfeed did a profile on Muthana who, at the time, “was one of the most militant members of so-called ISIS Twitter.” Her calls to action included “messages urging American Muslims to kill citizens in drive-by shootings and vehicular attacks, and calls to assassinate then-president Barack Obama.”

Only four years later, in February of this year, Muthana declared herself an American who wanted to “return home with her son, even if it meant facing criminal charges and jail time.” Reportedly Muthana and her son escaped to a Kurdish refugee camp in late 2018. Is it surprising to anyone that an American prison would be preferred to a refugee camp surrounded by fighting?

“I was really young and ignorant…I believe that America gives second chances. I want to return, and I’ll never come back to the Middle East. America can take my passport and I wouldn’t mind” Muthana said in an interview with the Guardian. In a case with many twists and turns, both Secretary of State Mike Pompeo and President Trump said earlier this year that Muthana would not be allowed into the United States because she is not a US citizen. The next day, her father filed a lawsuit on behalf of Muthana and her son against the government in federal court to allow them into the country.

The federal judge ruled yesterday that Muthana is not an American citizen because “Federal regulations and international law state that children of foreign diplomats born in the US are not subject to the 14th Amendment to the Constitution, which guarantees birthright citizenship, because they are born under the jurisdiction of another country.”
