Judge Juan Merchan has scheduled Trumpâs sentencing for the politically motivated lawfare âHush Moneyâ conviction on January 10, ten days before his inauguration. Trumpâs legal team had requested that he dismiss the charges based on presidential immunity, which he declined.
Merchan guaranteed that Trump would not serve time, and will be allowed to appear virtually at his sentencing. Seemingly, the sentencing serves no other purpose except to finalize the âconvicted felonâ label on Trump.
The âhush moneyâ case was the result of the George Soros-backed Manhattan District Attorney Alvin Bragg, which eventually resulted in a New York court finding President Trump guilty on all 34 counts related to the bogus case. Trump was indicted on March 30, 2023, over six years after the earliest charge in Braggâs indictment, dated February 14, 2017, which exceeds the five-year statute of limitations. However, Judge Merchan determined that New York Governor Andrew Cuomo extended the time limit to file charges in all criminal cases when courts were disrupted by the COVID-19 pandemic, thereby extending the prosecution deadline by over a year in this case.
Trump has now sued Merchan and Bragg on Monday over the judge's denial of his presidential immunity motions.
In denying Trump's request to halt the sentencing, Merchan wrote, "This Court has considered Defendant's arguments in support of his motion and finds that they are for the most part, a repetition of the arguments he has raised numerous times in the past."
"Further, this Court finds that the authorities relied upon in the instant motion by the Defendant are for the most part, factually distinguishable from the actual record or legally inapplicable," Merchan wrote.
Meanwhile, President Trump went scorched earth on Bragg on his social media platform Truth Social ahead of sentencing. âD.A. Alvin Bragg never wanted to bring this lawless case against me. He was furious at the way it was handled, and especially angry at MARK POMERANTZ for his behavior, and what he did. Ultimately, the Biden/Harris DOJ forced Bragg to concoct anything to embarrass TRUMP.â
Judge Merchanâs daughter has worked for the Democratic party, including the Harris-Walz campaign, from which her marketing firm received tens of millions. She also helped Democrats raise $93 million from the case, further suggesting that Judge Merchan could be personally interested in the outcome of the case.
